1. Scope

These terms and conditions apply to all orders placed through our online shop. Our online shop is exclusively intended for consumers.

For Germany: Consumers, according to § 13 BGB, are any natural persons who conclude a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity.

For Austria: In the following conditions, "consumer" refers to the "consumer" as defined in the Consumer Protection Act (KSchG).

For Switzerland: In the following conditions, "consumer" refers to the "consumer" according to Swiss law.

2. Contracting Party, Contract Conclusion, Correction Options

The purchase contract is concluded with Moser Trachten GmbH.

By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can first place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order using the correction tools provided and explained in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation email.

3. Contract Language, Storage of Contract Text

The available contract languages are German and English.

We store the contract text and send you the order details and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery Conditions

4.1 Shipping Costs

In addition to the stated product prices, shipping costs apply. These depend on the packaging dimensions of the respective product:

Shipping to Germany and Austria:

Germany:
• Up to 1 kg: €4.95
• 1 kg to 5 kg: €5.95
• Over 5 kg: €6.95

Austria:
• Up to 1 kg: €10.90
• Over 1 kg: €12.90

Shipping to Switzerland:

• Up to 2.5 kg: €15.00
• 2.5 kg to 5.0 kg: €17.00
• Over 5.0 kg: €19.00

Express shipping surcharge:

• Next business day delivery: €16.95 *

• Express surcharge for Saturday delivery: €26.95 

• Available only for customers in Germany.

4.2 Delivery Options

We ship the products to the delivery address specified in the order process.

We only deliver via shipping. Self-collection of goods is unfortunately not possible.

5. Payment

5.1 Prices

The prices listed at the time of ordering apply. These are total prices and include statutory VAT.

5.2 Payment Methods

The following payment methods are generally available in our shop:

Bank Transfer (Prepayment)
If you choose prepayment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.

Credit Card
During the order process, you provide your credit card details. Your card is charged immediately after placing the order.

PayPal Plus
In collaboration with PayPal (Europe) S.à r.l. et Cie, S.C.A, we offer various PayPal payment options. You do not need a PayPal account unless otherwise specified. More information is provided during checkout.

Amazon Pay
If you use Amazon Pay, you must be registered with Amazon, authenticate with your credentials, and confirm the payment. The payment transaction is completed within one banking day.

6. Retention of Title

The product remains our property until full payment is received.

For customers in Switzerland, we are entitled to register a corresponding entry in the retention of title register.

7. Transport Damage

If goods are delivered with obvious transport damage, please report such defects immediately to the carrier and contact us without delay. Failure to file a complaint or contact us has no consequences for your legal claims and enforcement, especially your warranty rights. However, you help us assert our claims against the carrier or transport insurance.

8. Warranty and Guarantees

8.1 Warranty Rights

Statutory warranty rights apply.

For consumers in Switzerland: Please inspect the received goods as soon as possible and immediately report any defects. Failure to do so will result in the goods being considered accepted unless the defect was not visible during the inspection. If defects are discovered later, they must be reported immediately after detection.

8.2 Guarantees and Customer Service

Information about applicable additional warranties and their exact conditions can be found with the respective product and on special information pages in our online shop.

9. Liability

We are always liable for claims due to damages caused by us, our legal representatives, or agents:

  • In case of injury to life, body, or health
  • In case of intentional or grossly negligent breach of duty
  • For guarantee commitments, if agreed
  • Where the scope of the Product Liability Act applies

For breaches of essential contractual obligations, we are only liable for foreseeable damages typical for the contract, provided such damages were caused by slight negligence. Otherwise, claims for damages are excluded.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which can be found here. We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.

The competent arbitration board is the Universal Arbitration Board of the Federal Republic of Germany at the Center for Arbitration e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de.
